Increased immigration enforcement actions are prompting restaurants to include ICE raids in their safety planning. According to David Asser, a partner at Messner Reeves, federal agencies such as Homeland Security Investigations (HSI), Enforcement and Removal Operations (ERO), and Customs and Border Protection (CBP) have intensified worksite enforcement across various industries, including the restaurant sector.

Asser describes the current climate as one where “the Administration’s surge in worksite enforcement actions across the country is part of a disturbing pattern: an immigration enforcement system focused on instilling fear rather than on upholding the law.” He notes that Immigration and Customs Enforcement (ICE) has publicized its increased focus on workplace raids through alerts, press releases, and social media posts showing agents equipped with tactical gear.

The article also highlights a trend of unidentified agents conducting arrests outside worksites. “This trend is likely to intensify given the Supreme Court’s ruling allowing federal agents in Los Angeles to target individuals for simply going to work at sites such as farms, restaurants, carwashes, and construction sites,” Asser states. These developments have led to operational disruptions and anxiety among workers.

Employers now face more complex compliance requirements and risk both civil and criminal penalties if found in violation. The lack of clear guidance from agencies regarding employment verification further complicates matters for businesses attempting to follow regulations.

Asser points out that recent legislative changes have contributed to these challenges. The One Big Beautiful Bill Act (OBBBA) has tripled ICE’s budget, leading to increased enforcement activities that affect both businesses and workers.

To address these risks, Asser recommends several strategies for restaurants:

– Stay informed about changing immigration laws.
– Develop response plans for ICE inspections.
– Conduct regular internal audits of employment verification processes.
– Foster open communication with employees about their rights.
– Prepare contingency plans for potential labor shortages or disruptions.

He emphasizes the importance of legal support: “By taking these proactive steps, restaurants can better manage risks related to ICE enforcement, support employees, and maintain business stability.”

Messner Reeves offers services such as I-9 compliance assistance, audits, discrimination claims management, and H-1B LCA compliance for businesses in the restaurant industry.
